OVERVIEW AND ACCEPTANCE OF TERMS
You agree that by creating an account with Vadera Capital LLC (“Vadera Capital,” “we,” or “us”), or by accessing or using our Services and Websites (as defined below), you confirm that you have read, understood, and consent to be bound by this Terms of Use Agreement, and the terms, conditions, and notices set forth herein (the “Agreement”). This applies whether you are a “Visitor” (browsing the Website) or a “Customer” (registered user or account holder).
You may access or use our Services subject to this Agreement. Services may include free tools or products, or paid services with a one-time or recurring fee. The term “Services” includes, but is not limited to, checking account access, debit card services, credit insights, creator analytics, lending offers, and other financial technologies offered by Vadera Capital through our Sites or mobile applications.
Your use of our Site and Services signifies your agreement to this Agreement and all applicable laws. If you do not agree, do not use the Site or Services. This Agreement may be updated periodically without notice. Continued use of the Site or Services constitutes your acceptance of the most current terms.
PERMISSIBLE PURPOSE AND CONSENTS
By creating an account or requesting Services from Vadera Capital, you provide written instructions under the Fair Credit Reporting Act (“FCRA”) authorizing us to obtain credit reports, credit scores, business financial data, and identity verification data from third parties such as credit bureaus, banking providers, and data aggregators (e.g., Plaid, Stripe, TikTok, YouTube) to:
- Provide personalized offers and insights
- Verify identity and prevent fraud
- Monitor user eligibility for lending and financial products
We may receive compensation from financial institutions and partners for presenting their offers within our platform. This may affect placement but not content integrity.
GENERAL DESCRIPTION OF SERVICES
Vadera Capital offers:
- FDIC-insured checking accounts via our partner bank
- Visa debit cards (physical and virtual)
- Creator analytics and insights to assess growth across TikTok, YouTube, Instagram, and more (coming soon)
- Business funding offers and small business loans
- Tools for credit building, cash flow visibility, and income tracking
Services are provided for informational and educational purposes. We do not guarantee approval of any financial product and do not provide legal, tax, or financial advice. Any third-party offers are subject to the terms and conditions of the respective providers.
USE OF SERVICES
By using the Site or Services, you agree to provide accurate and current information. If we suspect any fraudulent or misleading activity, we may suspend or terminate access without notice.
Users must be 18 years or older. You agree that Vadera Capital is not liable for any delays, denials, or financial decisions made by third-party lenders or partners. All information you submit may be retained for compliance or verification purposes.
MODIFICATION OF PRODUCTS
We may modify, suspend, or discontinue any Service or feature without notice. Vadera Capital is not liable for any changes, and your continued use of the Services constitutes acceptance of those changes.
DISPUTE RESOLUTION BY BINDING ARBITRATION
If you have a concern, please first contact support@vaderacapital.com. Any disputes that cannot be resolved informally shall be settled through binding arbitration in accordance with the rules of the American Arbitration Association (AAA). Arbitration shall be conducted on an individual basis, and class actions are not permitted. The prevailing party shall be entitled to recover legal fees.
LIMITATION OF LIABILITY
To the maximum extent permitted by law, Vadera Capital is not liable for any indirect, incidental, or consequential damages arising from your use of our Site or Services. Total liability will not exceed the amount you paid to Vadera Capital for Services.
NO WARRANTY
All Services and content are provided “as is” and “as available.” We make no warranties of any kind, express or implied, including but not limited to merchantability or fitness for a particular purpose. Vadera Capital does not guarantee accuracy, timeliness, or completeness of information.
ELECTRONIC COMMUNICATIONS
By registering with Vadera Capital, you consent to receive communications electronically, including account notices, disclosures, and promotions. You may withdraw this consent by contacting us. Withdrawal may impact your access to certain services.
THIRD-PARTY SERVICES
Some features may involve linking to or using third-party sites or APIs (e.g., Plaid, YouTube, Stripe). Vadera Capital is not responsible for content or services provided by third-party partners. Use of these features is at your own risk and subject to the third party’s terms.
INTELLECTUAL PROPERTY
All content on our Site and platform, including logos, software, graphics, and text, is the property of Vadera Capital or its partners and is protected by copyright, trademark, and intellectual property laws. Unauthorized use is prohibited.
TERRITORIAL RESTRICTIONS
Our Services are intended for U.S. residents only. We may limit access to our Site or Services based on location or regulatory requirements.
CHILDREN’S PRIVACY
Vadera Capital does not knowingly collect information from users under 18 years of age. Our Services are not intended for minors.
ENTIRE AGREEMENT
These Terms and Conditions, our Privacy Policy, and any applicable Service-specific terms represent the full agreement between you and Vadera Capital. If any provision is deemed invalid, the remaining provisions remain in effect.
