Terms of Service
These Terms of Service ("Terms") govern your access to and use of Pulse and the related websites and services (the "Services") provided by Vadera Capital Corporation ("Vadera," "we," "us"). Please read them carefully.
01 Acceptance of Terms
By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
02 Eligibility
You must be at least 18 years old to create an account. Some connected platforms or optional features may have additional age or eligibility requirements. You are responsible for ensuring your use complies with the terms of any connected platform.
03 Description of the Services
The Services include Pulse, which computes a verified score from your live creator performance data, creator profile tools, reports, and related account features.
04 Accounts & Security
You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us promptly at support@vaderacapital.com if you suspect unauthorized access.
05 Connected Accounts & Authorization
When you connect a platform, you authorize Vadera to use a secure platform connection to retrieve the account metrics needed to calculate and display Pulse and related reports. We do not post, edit, or change anything on your connected accounts. You may disconnect any platform at any time, which stops future collection from that platform.
06 Limited Permission You Grant
You allow Vadera to host, process, and display connected-account data only as needed to provide Pulse, your public profile, and the user-facing reports you request. This permission does not give Vadera the right to sell connected-account data or use it for unrelated research, advertising, or promotion.
07 Pulse Score — Nature & Limitations
The Pulse Score is a proprietary, informational metric. It is not a credit score and is not financial advice, and it is not used in any lending decision. We do not guarantee any outcome, including brand deals, rates, or earnings, from your use of the Services.
08 Acceptable Use
- Do not use the Services for any unlawful, fraudulent, or deceptive purpose.
- Do not attempt to gain unauthorized access to the Services or other users' data.
- Do not interfere with, disrupt, or place undue load on the Services.
- Do not misrepresent your identity or your connected-account data.
09 Intellectual Property
Vadera owns all rights in the Services, including the Pulse scoring engine, software, and brand. You retain ownership of content you provide, subject to the license granted above.
10 Third-Party Platforms
The Services interoperate with third-party platforms we do not control. We are not responsible for those platforms or their availability, content, or practices. Your use of them is governed by their terms.
11 Optional Financial Features
Some optional services may request additional profile, payment, or business information before you use them. Those services are separate from Pulse and will show their own eligibility requirements, fees, and terms at activation. Pulse is not a credit score, financial advice, or a lending decision factor.
12 Fees & Subscriptions
Some features may require paid subscriptions. Fees are non-refundable except where required by law. We may change fees prospectively with notice as required.
13 Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the fullest extent permitted by law.
14 Limitation of Liability
To the fullest extent permitted by law, Vadera will not be liable for indirect, incidental, special, consequential, or punitive damages. Vadera's total liability for any claim is limited to the greater of the amounts you paid to Vadera in the 12 months before the claim or US$100.
15 Indemnification
You agree to indemnify and hold Vadera harmless from claims, losses, and expenses arising out of your use of the Services, your content, or your violation of these Terms.
16 Dispute Resolution & Arbitration
These Terms are governed by the laws of the State of Florida. Any dispute will be resolved by binding individual arbitration in Orange County, Florida. You and Vadera waive the right to a jury trial and to participate in a class action.
17 Termination
You may close your account at any time. We may suspend or terminate your access if you violate these Terms or to protect the Services. Provisions that by their nature should survive termination will survive.
18 Changes to These Terms
We may update these Terms from time to time. Changes are effective upon notice, and your continued use of the Services constitutes acceptance of the updated Terms.
19 General
These Terms are the entire agreement between you and Vadera regarding the Services. If any provision is unenforceable, the rest remains in effect. You may not assign these Terms without our consent; we may assign them in connection with a business transaction.
